Privilege Committee Action legally unsustainable, Supreme Court has previously held successor Assembly cannot Act on previous term: AAP
Delhi: The Aam Aadmi Party (AAP) strongly condemned the BJP-led Delhi Government for weaponising the Delhi Assembly Privilege Committee by issuing notices to senior AAP leaders- Arvind Kejriwal, Manish Sisodia, Ram Niwas Goel, and Rakhi Birla – in the so-called “Faansi Ghar issue.” The AAP affirmed the move was a desperate attempt to deflect attention from the BJP government complete governance collapse in Delhi over the past nine months.
In a statement, the AAP said that it has been nine months since the BJP came to power in Delhi and during this period the condition of the city has deteriorated beyond measure. Mohalla Clinics are being shut down, government schools are being neglected, buses are in short supply, roads are broken across major routes, air pollution is spiraling and areas like Dwarka, Deoli and Chhatarpur are grappling with severe water shortages. “The BJP government has dismantled every system that the Arvind Kejriwal-led AAP government built for the welfare of Delhi people,” AAP said.
Highlighting the government failures, the AAP said that Delhi public transport system is on the verge of collapse, with bus fleets shrinking.
“Thousands of commuters suffer daily due to inadequate bus services. Women, students and working-class citizens who once benefited from a robust bus network are the worst affected,” the party noted.
The AAP said that Delhi roads are in shambles with potholes, incomplete repair work and delayed maintenance becoming a citywide hazard. “The BJP government talks about making Delhi world-class, yet the reality is visible on every street- broken roads, rising pollution and administrative apathy,” it added.
The party further said, “Instead of fixing these issues, the BJP government is busy sending notices and staging political theatrics. Delhi governance has turned into a circus — all noise, no work.”
On pollution, AAP reminded the government that the smog tower initiative has been abandoned, in the name of artificial rain the BJP government burned taxpayers’ money and pollution data is being manipulated to hide failures. “Nine months into power and Delhi continues to choke — yet the BJP only response is political blame games,” AAP said.
The party also condemned the BJP for allowing hundreds of Mohalla Clinics to shut down or function without doctors and medicines, depriving lakhs of citizens of affordable primary healthcare. “The same government that promised to strengthen healthcare is dismantling it. What can be more anti-people than that?” AAP asked.
Slamming the government failure on basic utilities, AAP pointed out, “Delhi poor and middle-class families are queuing for water tankers in 2025. Societies in Dwarka, Janakpuri and other planned areas are struggling for basic supply. This is the state of governance under BJP rule.”
Noting BJP failing on every front — from pollution to healthcare, education, transport, water and infrastructure- AAP said the ruling party only focus is mudslinging and harassment of opposition leaders. “Issuing notices to Arvind Kejriwal, Manish Sisodia, Rakhi Birla and Ram Niwas Goel will not hide the BJP incompetence,” the party asserted.
Calling on the BJP to rise above politics, AAP said, “Elections are long over. The people of Delhi have elected you to govern, not to indulge in vendetta. It high time BJP wakes up and begins working for the betterment of Delhi citizens. The people deserve governance, not daily drama.”
Commenting on the legality of the notice, the AAP asserted, “The incident mentioned in the Privilege Committee Communication (PCC) took place in August 2022, during the term of the 7th Legislative Assembly of Delhi. However, after the 7th Legislative Assembly of Delhi was dissolved in February 2025, and on 09.09.2025, the Privilege Committee of the 8th Legislative Assembly of Delhi issued the PCC.”
“After the dissolution of the 7th Legislative Assembly of Delhi, the 8th Legislative Assembly of Delhi cannot initiate privilege action for actions of the members in the 7th Legislative Assembly,” the party added.
To this extent, AAP places reliance on the decision of the Supreme Court in Amarinder Singh V. Punjab Vidhan Sabha (2010). “This makes the Privilege Committee action not only politically motivated but also legally unsustainable,” the party added.
The party pointed out that the BJP is misusing the Privilege Committee for political vendetta while Delhi pressing issues go unaddressed. “This Legislative Assembly of Delhi represents the aspirations of the people of Delhi and the Privilege Committee is tasked with ensuring that those aspirations are respected and that institutional integrity is preserved. The people of Delhi deserve a better life, better amenities, and better conditions of living. The 8th Legislative Assembly of Delhi and particularly this Privilege Committee, has more urgent tasks at hand and in the interest of the people of Delhi, will abort this misadventure — which is nothing but a vendetta-oriented distraction strategy, bound to fail not only in a court of law, but in the court of the people,” the AAP said.
