Why Is the US Scrutinising H-1B Applicants’ Social Media?

New Delhi: United States H-1B and H-4 visa holders have reportedly received emails from consulates stating that their temporary work visas have been “prudentially revoked.” The move comes amid the postponement of H-1B visa interviews in India and as the US expands scrutiny of applicants’ social media accounts, a review previously limited to international students seeking to study in the country.

Notably, prudential visa revocation is a temporary, precautionary measure taken as a matter of caution and does not amount to a permanent visa denial.

The Trump administration said on Sunday that beginning December 15, H-1B visa applicants and their H-4 dependents in the US will be subject to enhanced screening, including expanded social media vetting.

The US State Department issued a new directive requiring H-1B applicants and their H-4 dependents to make their social media profiles public as part of the visa vetting process.

“To facilitate this vetting, all applicants for H-1B visas and their dependents under the H-4 category, as well as F, M and J non-immigrant visas, are required to set the privacy settings on all their social media profiles to ‘public’,” the US State Department said.

Several H-1B visa holders in India have seen their interviews rescheduled as expanded social media vetting slows visa processing timelines.

What Is Prudential Visa Revocation?

A prudential visa revocation is a temporary, precautionary cancellation carried out before any wrongdoing is formally established. It allows US authorities to revoke a visa as a safety or compliance measure, rather than as a punishment. Under the US State Department’s Foreign Affairs Manual, visas may be “prudentially revoked” while officials review potential concerns.

The prudential visa revocation allows US authorities to pause the person’s visa status while they review concerns. It is called “prudential” because it is done out of caution, not because guilt has been proven. “We are seeing more prudential visa revocations for H-1B and H-4 holders who had a past interaction with law enforcement, even with no conviction. Many of these incidents were already disclosed and cleared in earlier visa stamps.

A revocation does not affect lawful stay in the United States, but it means the issue will be reexamined at the next visa appointment. Hard to see how this is an efficient use of government resources when the incident was already previously vetted,” said immigration attorney Emily Neumann on X.
